Terms & Conditions
Effective July 29, 2026
Plain-English summary: American Laborers is a marketplace that connects customers with contractors and skilled labor. We are not the contractor. Contractors are independent professionals. Payments run through Stripe. We take a 4% platform commission. Use our services legally, honestly, and at your own risk.
01Acceptance of Terms
By creating an account, posting a project, submitting a bid, booking labor, or otherwise using American Laborers (the "Platform"), you agree to these Terms & Conditions ("Terms") and our Privacy Policy. If you do not agree, do not use the Platform.
02Who We Are
American Laborers ("we", "us", "our") operates a two-sided marketplace where:
- Customers post construction, cleaning, maintenance, moving, landscaping, demolition, and other property-service projects, or book skilled/general labor by the hour.
- Contractors and Laborers ("Service Providers") submit bids or accept bookings, then perform work directly for the Customer.
03Eligibility
You must be at least 18 years old and legally able to enter into contracts. Service Providers must possess and maintain any licenses, insurance, bonds, and permits required by federal, state, and local law for the services they offer. You represent that all information you provide is accurate, current, and complete.
04Accounts & Security
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately of any unauthorized use. We may suspend or terminate accounts that violate these Terms or applicable law without notice.
05Payments, Commissions & Refunds
- All payments are processed by Stripe, Inc. Stripe's terms apply to payment processing. We never store your full card number.
- The Platform charges a 4% commission on completed jobs and separate fees for subscriptions and advertising as disclosed on the pricing pages.
- Recurring/auto-charged bookings: by saving a card and enabling auto-billing, you authorize us to charge that card at the lead time and cadence you selected. Failed charges will retry up to five times.
- Refunds for booked services are handled through the workspace dispute process and, when reasonable, at our sole discretion. Platform fees (subscriptions, ads, bid credits) are non-refundable unless required by law.
- All prices are in USD unless stated otherwise. Taxes are the responsibility of the Service Provider and, where applicable, the Customer.
06Bookings, Cancellations & No-Shows
Customers may cancel bookings up to 24 hours before the scheduled start without penalty. Later cancellations may be subject to a cancellation fee equal to the first hour of the booked crew rate. Service Providers must arrive on time, in a fit condition to work, and complete the scope agreed. Repeated no-shows may result in account termination.
07Service Provider Obligations
Service Providers agree to (a) perform work in a professional, workmanlike manner, (b) comply with all applicable laws, codes, permits, and licensing requirements, (c) maintain liability insurance appropriate to the trade, (d) not engage in discriminatory conduct, (e) not solicit customers off-platform to avoid commission, and (f) resolve disputes through the workspace before public review.
08Customer Obligations
Customers agree to (a) provide accurate scope, photos, and site access, (b) treat Service Providers with respect and pay agreed amounts on time, (c) not use the Platform to hire workers for anything illegal, and (d) not misrepresent their identity or intent.
09Independent Contractor Relationship
Service Providers are independent contractors, not employees, agents, or partners of American Laborers. We do not withhold taxes, provide benefits, control the manner or means of the work, or supply tools or equipment. Nothing on the Platform creates a joint venture, employment, partnership, or franchise relationship.
10Prohibited Conduct
You will not: post false or misleading listings; harass, threaten, or discriminate against any user; circumvent Platform payments; upload malicious code; scrape, reverse-engineer, or attempt to disrupt the Platform; impersonate another person; violate intellectual-property or privacy rights; or use the Platform for money laundering, fraud, or any illegal activity.
11Content & Media
You retain ownership of the photos, videos, descriptions, and other materials you upload ("User Content"). You grant American Laborers a worldwide, non-exclusive, royalty-free license to host, store, display, and distribute User Content solely as needed to operate and market the Platform. You represent that you have the rights necessary to grant this license and that your User Content does not infringe on any third party's rights.
12Reviews & Ratings
Reviews must be truthful, based on first-hand experience, and free of profanity, threats, or personal information. We may remove reviews that violate these Terms, but we do not otherwise edit or curate reviews.
13Disclaimers
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE." WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR QUALITY OF SERVICE PROVIDERS. WE DO NOT VERIFY EVERY LICENSE, INSURANCE POLICY, OR BACKGROUND CHECK, AND WE ARE NOT RESPONSIBLE FOR THE ACTS OR OMISSIONS OF SERVICE PROVIDERS OR CUSTOMERS.
14Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AMERICAN LABORERS AND ITS OFFICERS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THE PLATFORM. OUR TOTAL LIABILITY IN ANY 12-MONTH PERIOD WILL NOT EXCEED THE GREATER OF (A) FEES YOU PAID TO US IN THAT PERIOD OR (B) US $100.
15Indemnification
You agree to defend, indemnify, and hold harmless American Laborers from any claim, damage, liability, or expense (including reasonable attorneys' fees) arising from your use of the Platform, your User Content, your violation of these Terms, or your violation of any law or third-party right.
16Dispute Resolution & Arbitration
Any dispute arising out of or relating to these Terms or the Platform will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, in the state of your residence. YOU AND AMERICAN LABORERS WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN CLASS ACTIONS. You may opt out of arbitration within 30 days of first accepting these Terms by emailing us at americalaborers@gmail.com with your name and account email.
17Governing Law
These Terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to conflict-of-law principles.
18Changes to These Terms
We may update these Terms from time to time. Material changes will be notified via email or in-app notice at least 14 days before taking effect. Your continued use of the Platform after the effective date constitutes acceptance of the updated Terms.
